1. Scope & acceptance
These Terms & Conditions ("Terms") govern your access to and use of the SMOXIT website (smoxit.app), the onboarding portal (my.smoxit.app), and any related services (together, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
2. The service
SMOXIT is an AI-powered companion designed to support people who want to quit smoking or vaping. The Service includes a personalised quit plan, an AI coach, progress tracking, and educational content.
SMOXIT is a wellness and habit-change tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment.
3. Your account
- You must be at least 18 years old to create an account.
- You are responsible for keeping your login credentials confidential.
- You agree to provide accurate information during onboarding.
- One person, one account — no sharing.
4. Payments & subscription
SMOXIT is offered as a monthly subscription at €9.95 per month, charged in advance. The price includes VAT where applicable.
Payments are processed by our payment provider. By subscribing, you authorise us to charge your selected payment method on a recurring monthly basis until you cancel.
5. Cancellation & refunds
You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you keep access until then. We do not provide pro-rata refunds for partial months.
EU consumers: you have a 14-day right of withdrawal in line with your statutory consumer rights. Contact us at hello@smoxit.app to exercise it.
6. Health disclaimer
SMOXIT does not replace professional medical, psychological, or addiction-treatment advice. If you experience severe withdrawal symptoms, mental-health distress, or any medical concern, consult a qualified healthcare professional.
If you are pregnant, breastfeeding, taking medication, or living with a medical condition, please speak to your doctor before changing your nicotine intake.
7. Acceptable use
You agree not to:
- Reverse-engineer, scrape, or copy the Service or its content;
- Use the Service to harm, harass, or impersonate others;
- Submit unlawful, abusive, or misleading content;
- Attempt to bypass security or access another user's account.
8. Intellectual property
All software, design, copy, logos, and content on the Service are owned by SMOXIT or our licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes.
9. Limitation of liability
To the fullest extent permitted by law, SMOXIT is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability in any 12-month period is limited to the amount you paid us during that period.
Nothing in these Terms limits liability for fraud, gross negligence, or anything else that cannot be limited under applicable law.
10. Changes to these terms
We may update these Terms from time to time. If a change is material, we'll notify you by email or in-app at least 14 days in advance. Continued use of the Service after the change means you accept the new Terms.
11. Governing law & jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany. The courts of Cologne shall have exclusive jurisdiction, except where mandatory consumer-protection law of your country of residence provides otherwise.
